Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) governs your use of KodeTools services, including the thrust desktop application and cloud services. This AUP is incorporated into and forms part of our Terms of Service.

Violation of this AUP may result in immediate suspension or termination of your access to the Services without notice or refund.

2. Prohibited Activities

You may NOT use the Services for any of the following purposes:

2.1 Illegal Activities

  • Violating any applicable local, state, national, or international law or regulation
  • Engaging in or promoting illegal activities, including but not limited to:
    • Hacking, cracking, or unauthorized access to systems
    • Distribution of malware, viruses, or malicious code
    • Intellectual property infringement or piracy
    • Identity theft or fraud
    • Money laundering or financing of illegal activities
    • Sale or distribution of controlled substances
    • Child exploitation or abuse material

2.2 Abusive Behavior

  • Harassment, threats, or intimidation of any individual or entity
  • Discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, personal beliefs (including political views), or other protected characteristics
  • Impersonation of any person or entity
  • Doxxing or publishing private information of others without consent
  • Spam or unsolicited communications

2.3 Security and System Abuse

  • Attempting to gain unauthorized access to the Services or other users’ accounts
  • Reverse engineering, decompiling, or disassembling the thrust application
  • Circumventing security measures or access controls
  • Denial of service attacks or attempts to overload or disrupt the Services
  • Scraping or automated data collection without permission
  • Using the Services to probe, scan, or test the vulnerability of any system

2.4 Fraudulent or Deceptive Practices

  • Providing false, misleading, or fraudulent information
  • Payment fraud or using stolen payment methods
  • Creating multiple accounts to abuse free trials or promotional offers
  • Selling, renting, or transferring your account to others

2.5 Resource Abuse

  • Excessive use of computing resources that impacts other users or the Services
  • Cryptocurrency mining or similar resource-intensive operations (unless explicitly permitted)
  • Running processes that consume excessive bandwidth, CPU, or storage

2.6 Harmful Content

  • Hosting, distributing, or sharing malware, viruses, or malicious code
  • Phishing sites or deceptive content designed to steal credentials or information
  • Content that violates intellectual property rights of others
  • Obscene, pornographic, or sexually explicit content (unless related to legitimate development projects)

2.7 Violations of Third-Party Rights

  • Infringing on patents, trademarks, copyrights, or trade secrets
  • Violating terms of service of third-party integrations (GitHub, GitLab, etc.)
  • Using the Services in ways that violate others’ privacy rights

3. Enforcement

3.1 Investigation

mooncloak reserves the right to investigate any suspected violation of this AUP. We may:

  • Monitor your use of the Services
  • Review your account activity and content
  • Cooperate with law enforcement or regulatory authorities
  • Disclose information as necessary to investigate violations

You have no expectation of privacy with respect to potential AUP violations.

3.2 Remedial Actions

If we determine that you have violated this AUP, we may take any of the following actions at our sole discretion:

  • Issue a warning
  • Suspend your account temporarily
  • Terminate your account permanently
  • Delete violating content
  • Restrict access to specific features
  • Report violations to law enforcement
  • Seek legal remedies, including damages and injunctive relief

These actions may be taken without notice, refund, or liability to mooncloak.

3.3 No Obligation to Monitor

mooncloak is NOT OBLIGATED to monitor user activity or content. We do not pre-screen content and are not responsible for content created or shared by users.

You are solely responsible for your use of the Services and any content you create or share.

4. Reporting Violations

If you become aware of any violations of this AUP, please report them to:

Include as much detail as possible:

  • Description of the violation
  • Username or account involved
  • URLs, screenshots, or other evidence
  • Date and time of the violation

mooncloak is not obligated to take action on all reports, but we will review them in accordance with our policies.

5. Copyright and DMCA Compliance

5.1 Copyright Infringement

If you believe that content on the Services infringes your copyright, you may submit a DMCA takedown notice to:

Your notice must include:

  • Your contact information
  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • A statement that you have a good faith belief that the use is unauthorized
  • A statement that the information is accurate and you are authorized to act
  • Your physical or electronic signature

5.2 Counter-Notices

If your content was removed due to a DMCA notice and you believe it was removed in error, you may submit a counter-notice.

5.3 Repeat Infringers

We may terminate accounts of users who repeatedly infringe copyrights.

6. Consequences of Violations

6.1 Immediate Termination

Serious violations may result in immediate termination without warning, including but not limited to:

  • Illegal activities
  • Security threats or attacks
  • Malware distribution
  • Child exploitation material
  • Egregious harassment or threats

6.2 Legal Action

mooncloak reserves the right to pursue legal action for violations of this AUP, including:

  • Civil lawsuits for damages
  • Injunctive relief
  • Cooperation with law enforcement for criminal prosecution

You agree to indemnify mooncloak for any costs, damages, or legal fees arising from your violations.

6.3 No Refunds

Accounts terminated for AUP violations are NOT entitled to refunds for any unused subscription time or fees paid.

7. Changes to This Policy

mooncloak reserves the right to modify this AUP at any time. Changes become effective immediately upon posting. Your continued use of the Services constitutes acceptance of the updated AUP.

It is your responsibility to review this AUP periodically.

8. No Liability

mooncloak SHALL NOT BE LIABLE for:

  • Actions of other users who violate this AUP
  • Consequences of our enforcement actions (account suspension, termination, etc.)
  • Any damages resulting from violations by you or other users
  • Failure to detect or prevent violations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY RELATED TO USER CONDUCT AND AUP VIOLATIONS.
